  • 1. Company Overview

      Welcome to the MOKO.mobi ("MOKO") web site & WAP site ("Sites" / "Services"). These Sites are operated by MOKO.mobi Limited ACN 111 082 485 ("we" or "us"). Your access to and use of the Sites is subject to these terms, theMOKO.mobi’s Privacy Policy and any other terms contained on the Web Site and / or WAP Site ("Terms and Conditions"). Every time you go to the Web Site or WAP site, you agree to access and use the Sites, and the material on the Sites, in accordance with the Terms and Conditions. The Terms and Conditions are a legally binding agreement between you and us.

  • 2. Service Description

      MOKO.mobi is a mobile social networking service that allows you set up a profile, chat, make new friends and post your pics and vids to the MOKO.mobi site for other people to view and share directly from your mobile phone.

  • 3. Changes to the Terms and Conditions

      From time to time, we may need to change these Terms and Conditions. We may change theTerms and Conditions at any time by posting the changed Terms on the Sites, and by posting a notice to users on our homepage stating that a change has occurred. Any change in the Terms and Conditions will not affect the terms of any pre-existing agreement between you and us regarding your acquisition of any products or services from the sites.

  • 4. Service and Registration

      4.1 Subject to your compliance with the terms and conditions of this Agreement, MOKO.mobi will provide the Services to you after you have successfully completed the registration process for the Services, which is made available to you through the Sites.

      4.2 Once your registration to the Sites is accepted for participation in the Services, you will be able to to post photos and videos, chat, access premium features, enter competitions and much more. Please check the sites for updated features and functionality.

  • 5. Site Rules

      5.1 The content and information on the sites are provided for your personal use only.

      5.2 Unless expressly stated otherwise on the sites, you may download the content and information on the sites onto your mobile phone and / or personal computer, but only to the extent necessary to allow you to view that content and information. You may also print hard copies of that content and information, but only for your own personal use and reference.

      5.3 You must use the Sites in a responsible manner, and in compliance with all relevant MOKO.mobi Rules

      5.4 You must not:

      • change, modify, adapt, manipulate, reverse engineer, decompile, distort or enhance any of the content or information on the Sites;
      • incorporate or merge any of the content on the Sites with any other material, including advertising or promotional material;
      • create HTTP links from the Sites to any other web site on the Internet and / or Mobile Internet; or
      • send, post, communicate or transmit to or via the Sites (including any chat rooms) any information or material which infringes a third party's rights (including intellectual property rights), or which is obscene, indecent, inflammatory, pornographic, defamatory, illegal, misleading or deceptive;
      • use the Sites or any facilities available on or via the Sites (including any chat rooms) to defame, harass, threaten, menace or offend any person, or behave in a way which inhibits another person from using or enjoying the Sites or those facilities;
      • tamper with, hinder the operation of, or make unauthorised modifications to the Sites or any content on the Sites;
      • knowingly transmit any virus, worm, trojan horse or other disabling feature to or via the Sites;
      • use the Sites to send commercial, unsolicited or bulk electronic messages to anyone or in any other way which would constitute an infringement of the Spam Act 2003 (Cth);
      • use another person's name, username or password on the Sites or to access any content on the Sites; or
      • attempt to do, or permit another person to do, any of the above acts.
      • slander the MOKO.mobi site or administration staff.
  • 6. Operation of Sites

      6.1 We will use reasonable efforts to make sure that you can access and use the Sites at all times. However, despite our efforts, the Sites may not be accessible at all times and you may experience interruptions, delays, errors or faults in your use of and access to the Sites. We will not be responsible to you or anyone else if these things occur.

      6.2 When you are using the Sites, we may require you to re-authenticate yourself from time to time - for example, if there has been a period of inactivity on the connection between your internet browser and our servers. We will not be responsible for any information you may lose if your access to the Sites is suspended or terminated in these circumstances.

      6.3 To enable you to access certain content on the Sites, we may provide you with a username, password or some other type of identifier. You agree that you are responsible keeping such identifiers secret and that you will responsible for the conduct of any person who uses your identifiers, whether or not you have authorised that use.

      6.4 We may receive fees or commissions (or both) from third parties in relation to some of the content, goods or services which we advertise, promote or make available on the Sites. You acknowledge and consent to us receiving those fees and commissions.

  • 7. Changes to Sites

      7.1 We (or our suppliers) may change the content, information, products and services provided on the Sites, and the prices for those things, at any time.

      7.2 If you purchase any products or services from the Sites, you will be charged the price that applies and is displayed at the time you request those products or services.

  • 8. Payment and Billing

      8.1 You acknowledge and agree that for each order you place through the Service, the full cost of Products you order (for which prices are subject to change without notice) assessed against your available credit.

      8.2 You acknowledge and agree that a SMS/MMS or web browser command originating from your account constitutes an authorisation for us to charge this amount to your account, and you assume all liability for and shall promptly pay any and all charges.

      8.3 Without limiting the foregoing, you acknowledge and agree that you will pay assessed charges for any and all orders placed from your account, regardless of whether you actually receive the Products.

      8.4 You agree to pay all fees charged by your Carrier in connection with your use of the Services. You acknowledge and agree that these rates depend on the applicable Carrier and your personal subscription package with that Carrier.

      8.5 We will provide you with reasonable notice of any material modification in the fees charged for the Services, which notice may be provided by posting the new fee schedule on the Sites.

      8.6 MOKO.mobi is available via Carrier portals and mobile internet. Data and standard network charges may apply. Pricing for MOKO.mobi varies depending on your region, you may incur subscription or pay as your go fees and charges. Click here for pricing most relevant to you.

      8.7 MOKO Points refers to the currency used on MOKO.mobi for buying premium features and functionality offered on the Sites. Please check our FAQs for more information.

      8.8 When you decide to buy MOKO Points by paying via your mobile phone bill, we will attempt to receive payment. If your order is accepted, we will send you a reverse charge text, which will automatically charge you for the Points. You will not be able to cancel once we begin to action your request.

      8.9 If any payment you have made via mobile bill or Paypal is rejected for any reason and you have already spent MOKO Points, you may be denied service on the Sites until a satisfactory payment is made via one of our payment providers.

  • 9. Linked Sites

      9.1 The Web Site may contain links to other web sites which are not maintained or controlled by us. These links are provided by us solely for your convenience. We do not accept any responsibility for broken or redirected links.

      9.2 We have not checked the accuracy, completeness or suitability of the content of, or the goods and services available from, any linked sites. Also, we do not review or monitor any linked sites. You must therefore make your own enquiries about the content, goods or services available from any linked site before relying on that content, or buying or using any of those goods or services. We will not be responsible for any loss or damage you suffer as a result of relying on, buying or using any content, goods or services from a linked site.

      9.3 The presence of links on the Sites should not be taken to imply that we endorse, sponsor or approve of any linked site, or any content, products or services available from that linked site, or that we are affiliated or associated with the owner or operator of any linked site.

  • 10. Our Liability to You

      10.1 To ensure that we can continue to provide you with quality content and services via the Sites, we and our related companies need to try to minimise the costs associated with operating the Sites.

      10.2 As a result, neither we nor our related companies can accept liability for any loss or damage you suffer as a result of using or accessing the Sites or any content, information, products or services available on or from those Sites, except to the extent that we are required to by law, such as State or Territory fair trading legislation and the Trade Practices Act 1974 (Cth).

      10.3 In particular, except to the extent required by law, we and our related companies do not accept, and specifically exclude, liability for any business losses, or losses of data or profits, or any other direct, indirect or consequential loss or damage, which you may suffer in connection with our supply, non-supply or defective supply of the Sites, or any content, information, products or services available on or from the Sites.

      10.4 As a guide, the Trade Practices Act 1974 (Cth) would require us to accept liability to you where:

      • we fail to supply the content on the Sites with due care and skill; or
      • the content we supply via the Sites is not reasonably fit for the purpose for which it is supplied.
  • 11. Your Liability to Us

      11.1 To minimise the costs associated with operating the Sites, we also require that you take responsibility for any harm we or our related companies suffer as a result of your use of the Web Site.

      11.2 You therefore agree to indemnify us and our related companies from and against any loss, damage, costs or expenses suffered by any of us arising out of or in any way connected to the use of the Sites by you or someone using your name and password.

      11.3 In particular, except to the extent required by law, we and our related companies do not accept, and specifically exclude, liability for any business losses, or losses of data or profits, or any other direct, indirect or consequential loss or damage, which you may suffer in connection with our supply, non-supply or defective supply of the Sites, or any content, information, products or services available on or from the Sites.

  • 12. Termination and Suspension

      12.1 We may immediately suspend, terminate or limit your access to the Sites and without notice to you:

      • If we reasonably believe that you have breached any of these Terms and Conditions
      • If you have failed to comply with one or more MOKO Rules, or fail to correct any breach after being asked to do so.
      • The managers and operators of MOKO.mobi and their agents, may also suspend or terminate your access and use of MOKO.mobi for any reason they deem appropriate and without further explanation.

      12.2 When this Agreement is terminated, your account will be blocked and you will no longer be able to use the Sites.

      12.3 After termination, it is your responsibility to cancel any fees, standing orders, or other authorisations you may have given for periodic payments to be made to us by third parties.

      12.4 You may choose to discontinue your participation or subscription to these Sites at any time by cancelling your subscription through your carrier (where applicable*), or internally in MOKO.mobi. If you fail to visit the site within any period of 90 days, your media submissions, profile and comments may be deleted.

      * This method of unsubscription is currently only applicable to users accessing the Sites with subscription such as via 3 Australia, Virgin Australia, Optus Australia.

      12.5 If you choose to discontinue your participation, cancel your subscription or your account is terminated for breaching our Terms and Conditions, any MOKO points accumulated or bought during your participation will not be refunded.

      12.6 Expired MOKO Points will not be refunded. As a matter of course, all MOKO Points expire 60 days after any unsubscription from the Sites This expiration can be prevented by resubscribing to the Sites at any point within that 60 day period.

  • 13. Indemnity

      You agree to indemnify, defend and hold harmless MOKO.mobi LImited, its agents, employees, representatives, licensors, affiliates, officers, directors, and partners, from and against any and all claims, liabilities, damages, losses, costs, expenses, fees (including reasonable lawyers' fees and court costs) resulting or arising from any third-party claim in connection with:

      • any information you (or anyone accessing the Services using your password) submit or transmit through the Services;
      • your use of or access to the Services;
      • your violation of this Agreement;
      • your violation of any rights of any third party; or
      • any viruses, trojan horses, worms, time bombs, cancelbots, spyware, or other similar harmful or deleterious programming routines input by you into the Services.

  • 14. Disclaimer

      14.1 By sending in material to MOKO.mobi, you agree to the following:

      • MOKO.mobi may use and publish any material that you submit both on the Sites and / or elsewhere. You agree to grant MOKO.mobi and its partners, affiliates and trusted third-parties a worldwide, perpetual, non-exclusive license to any material you submit. You need to make sure that you have permission from anyone else who is in a video and or picture before you send it in. MOKO.mobi reserves the right not to publish any submissions and may adapt or edit any material for publication both on the Sites and / or elsewhere. You will not be refunded for any rejected submissions.
      • MOKO.mobi may use and publish any material that you submit which is viewable to other MOKO.mobi users from other countries and or mobile carrier networks. You need to make sure that you have permission from anyone else who is in a video and or picture before you send it in. MOKO.mobi reserves the right to not publish any submissions and may adapt or edit any material for publication.
      • MOKO.mobi may use or publish your submitted material without liability to you for payment or otherwise. You warrant that the material is fit for publication and agree to indemnify us if any third party takes action against us in relation to the material you submit. You warrant that MOKO.mobi may publish the material you submit on the Sites or elsewhere and / or make use of any concepts described in it in MOKO.mobi products or services without liability to you and you agree not to take any action against us in relation to it. You also warrant that MOKO.mobi may pass any material / concepts on to partner / associate companies for similar use, without any liability to you and you agree not to take any action against us in relation to it.
      • All personal information gathered as part of your submission may be used by MOKO.mobi or its partner companies. Your personal information will be dealt with in accordance with MOKO.mobi’s Privacy Policy.

      14.2 You expressly agree that use of the services is at your own risk. The services are provided on an “As is” and “As available” basis.

      14.3 MOKO.mobi disclaims all warranties of any kind, whether expressed, implied or statutory, including but not limited to the implied warranties for merchantability, fitness for a particular use or purpose and non-infringement.

      14.4 We make no guarantee that the services will meet your requirements or that the services will be uninterrupted, timely, secure or error free.

      14.5 We do not warrant, guarantee or make any representations regarding the use or the results of the use of the services with respect to performance, accuracy, reliability, security capability, prevalence or otherwise.

      14.6 You understand and agree that any products you obtain through the use of the services is done at your own discretion and risk, and MOKO.mobi makes no warranty regarding any dealings with or transactions entered into with any other parties through the services.

  • 15. Trademarks, Copyright and other Intellectual Property

      15.1 All intellectual property relating to MOKO.mobi, including written material, logos, illustrations, audio clips, video clips and photos is protected by copyrights, trademarks, and other intellectual property rights that are owned and controlled by MOKO.mobi or by other parties that have licensed their material to MOKO.mobi.

      15.2 Material on MOKO.mobi is solely for your personal, non-commercial use. Without the prior written consent of the owner, modification of the materials, use of the materials for any purpose other than personal, non-commercial use is prohibited

      15.3"MOKO.mobi" (Mobile Kommunity) is a trade mark owned by MOKO.mobi Limited.

  • 16. General Matters

      16.1 If we need to notify you of any matter relating to these Terms and Conditions and you have given us your contact details, we ask, and you agree, that we may use post, fax or email to the relevant contact details notified to us. If we do use email, you will be taken to have received the email if it leaves our servers, unless we receive evidence to the contrary.

      16.2 If any of these Terms of Use are invalid, unenforceable or illegal in a particular jurisdiction, that term will be struck out for that jurisdiction only and the remaining terms will remain in full force.

      16.3 If we do not act in relation to a particular breach by you of these Terms of Use, this will not be treated as a waiver by us of our right to act with respect to subsequent or similar breaches.
